Alpine Ski Utah!!!

The best thing about winters in Utah is Skiing!!!

My father began teaching me to ski at the age of six and I love to ski.  I tried snowboarding once and may I just reiterate, I LOVE to ski!

I do have children that snowboard (after they learn to ski) and I support them, however whenever I go to the Alta ski resort they either ski with me or they don't go.

Recently four snowboarders sought the judicial system enforcement to force Alta to allow snowboarders.  It is quite refreshing to see a frivolous lawsuit such as this, thrown out of court.

U.S. District Judge Dee Benson threw out the lawsuit based on there being no constitutional guarantee for the right to snowboard.  If I remember correctly I believe the constitution protects the right to life, liberty and the pursuit of happiness.  Now hopefully if this is appealed the 10th Circus Court of Appeals doesn't come up with some weird explanation that these people are being discriminated against.

Here is to Judge Benson's profundity, "The equal protection clause is not a general fairness law that allows everyone who feels discriminated against to bring an action in federal court.  There are many forums plaintiffs can resort to in an attempt to accomplish their goal of snowboarding down the Baldy Chutes at Alta.  Seeking an injunction from this court is not one of them."

Landscaping and Planting a Tree

New home building seems to be on the uprise, especially here in Utah.  One of the things a lot of new home buyers ask is if the price of the home includes the landscaping.  Most to be built homes the list price does not include landscaping.  In fact I don't remember ever seeing one that does.

Anyway, landscaping is a very important part of a homes value starting with the curb appeal.  I've had many clients that when we have pulled up to a home, they have decided to not even go through the home because of the way the yard and landscaping look.  Though it is expensive it will have a huge impact on the value of the home.

So if you are in a home and there is no landscaping, get started even if it is only planting a new tree (make sure you have a master plan; nothing worse than trying to move a well established tree and not kill it in the process).

Down Payment Definition

For those of you new to the real estate market here is a quick definition of down payment as we use it in real estate.

It is also more commonly known as "Earnest Money" and "Cash at Settlement".  These combined amounts make up the down payment or the total "Cash at Settlement" and may have a big impact on your loan.  We'll talk another time about Earnest Money and let's focus on the Cash at Settlement which is your down payment.

According to investopedia.com a 'Down Payment' is: " A type of payment made in cash during the onset of the purchase of an expensive good/service. The payment typically represents only a percentage of the full purchase price..."

I've heard many lenders and realtors suggest that the down payment or earnest money should range from 3%-20% of the loan amount.   However, check with your lender to determine how much of a down payment you will need.  The loan options are constantly changing.  I've had a client close with a rural housing loan and they did not put down any cash at closing.  The same thing with some community development grants.  Make sure you understand your loan and the requirements for such things as a 2nd mortgage to cover down payment and closing costs or grants that are required to be paid back if the property is resold within a certain amount of time or other conditions not mentioned here.

Realtor.com has an article answering the question of how much you need for a down payment. 

In the article they talk about the different amounts that can be put down on a loan. 

FHA-insured loans only require 3.5% down, but with this loan you are required to pay mortgage insurance for the life of the loan. 

Most conventional loans range from 10%-20% down. According to realtor.com, the best amount to put down is 20%. With a 20% down payment you won't have to pay mortgage insurance, you might qualify for a lower interest rate, and since your borrowing less money you will have less to pay back.

Utah's Spiral Jetty - An artist's work on nature's canvas


The Spiral Jetty, this is a landmark many of you my have never heard of. This landmark is located in the middle of the Great Salt Lake. It's easier to see from above then when your right next to it. If your going to walk on the Jetty be sure to bring rain boots and be prepared to possibly get wet depending on the year. 

The Spiral Jetty was constructed in 1970 by Robert Smithson. If you want to learn more about this unique landmark check out Robert Smithson's video documenting the construction of the Spiral Jetty.
